Terms and Conditions

By using this website, communicating with us, and/or ordering goods and services from us, you agree to be bound by the following terms and conditions, as well as our privacy policy. Your statutory rights are not affected. These terms and conditions are subject to change at any time and without notice.

Definitions

"Indigo PC", "us", "we", "our", and similar, refer to Richard McGowan t/a Indigo PC, 514 Littlemoor Road, Weymouth, DT3 5NZ.

"The customer", "you", "your", and similar, refer to any customer (be it an individual or a corporate or non-corporate body) placing, or seeking to place, an order for goods and/or services from Indigo PC.

Ordering/Delivery Area

We currently accept orders from, and deliver to, addresses in South, West, East and Mid Dorset. We will consider orders from, and delivering to, addresses in North Dorset and the New Forest area; please contact us to find out more.

Description of Goods

As we deal with products of a highly technical nature, it is not possible for us to provide an exhaustive list of all technical specifications of the products we sell or otherwise deal with. Such technical specifications can be found on the websites and in the sales literature of the original manfacturers.

Images shown on this site are for illustrative purposes only. The final look of any system will depend on the components used and may not be as shown.

All descriptions of goods on this site are intended to be reasonable approximations of the final product. All performance figures are provided by manufacturers and/or suppliers and will vary depending on the overall system and its use.

Orders of Goods and/or Services

We reserve the right to refuse, at our discretion, to supply any goods and/or services ordered by you and refund any payment received without any notice or given reason.

All orders will be considered an offer to purchase the goods and/or services at the prices communicated, through this website or otherwise, subject to these terms and conditions. No form of binding agreement on our behalf shall be inferred or construed from the placing of an order until any goods have been dispatched to you, or final arrangement for the date of provision of services has been agreed.

In the case of an order of goods, we will aim to deliver those goods within 7 days of the receipt of payment for that order, and certainly no later than 14 days after that date of payment. As we are a small business, however, disruptions to our supply chain or other issues can greatly affect our ability to deliver an order on time, and we can offer no absolute guarentee as to the time of delivery. In such a scenario we will endeavour to keep you advised of the situation including any likely delivery date and your right of cancellation and refund.

Payment for Goods

As is standard practice for system integrator businesses, we require payment of the full cost of any order before processing of that order begins. The method of payment is to be agreed by the customer and Indigo PC and we currently accept bank transfer, Paypal transfer or payment by card or PayPal through PayPal invoicing. If the order is cancelled by us, or if required by your statutory rights, all relevant payments will be refunded in full.

Cancellation of Orders

Under distance selling regulations, an individual consumer (though not a business) has the statutory right to cancel any order from the time it is placed until 14 days after the delivery of the goods for a full refund of the cost of the order, less any legitimate deductions.

In the case that the goods have been delivered, you must notify us that you wish to cancel the order either in writing or by email. The goods must be returned at the cost and liability of the customer, and must be received within 14 days of the notification of cancellation. Upon receipt of the goods within this time frame, your refund will be processed within 14 days. We may, solely at our own discretion, agree to collect these items; we reserve the right to charge a fee of up to £20 for such collections. All goods must be returned in the condition in which they were received, including all packaging, contents of that packaging, documentation, accessories, etc. No refund will be offered for any software or consumable that is in any condition that would prevent their resale; this includes, but is not limited to, the software having been activated or the packaging opened and/or unsealed.

In the event that any goods are not returned to us in the condition in which they were received, or are missing from the return, we reserve the right to deduct the cost of repairing or replacing those items from any refund.

Damaged Goods

If goods are received by the customer in a damaged state, this must be reported to us within 72 hours of receipt of the goods with valid photo evidence. Beyond this time frame we will consider any damage to have been caused by the customer and/or other user, for which we are not liable. We may, in exceptional circumstances and solely at our own discretion, accept reports of goods received in a damaged state outside of this time frame.

Warranties and Repairs

Our standard warranty period is one year (parts and labour) on a collect-and-return basis. Should you require a different warranty arrangement, pleae contact us and we will be happy to discuss it with you.

All goods are tested to ensure basic functionality before dispatch. In the case that goods are received that do not function as intended, or within the warranty period develop a fault, you will be responsible for contacting us to arrange a suitable repair.

Some manufacturers may offer a warranty for individual components that are longer than the warranty we offer. In the event of a fault developing outside of our warranty period, it is your responsibility to effect such a warranty and install, or arrange for the installation of, any replacement component. We may, solely at our own discretion, agree to make a warranty claim on your behalf with the manufacturer and install any replacement components. We reserve the right to charge our standard rate for such a service.

Any repairs undertaken by a third party at the instruction of the customer and without our express consent may, at our own discretion, void any relevant warranty. We will not be responsible for the cost of such a repair, or for any other costs incurred as a result thereof. Any upgrades made to a system, by the customer or a third party, will void the warranty if the upgrade is the cause of, or likely contrbutor to, any subsequent faults.

Any warranties or similar offered by us are not valid in the case of user damage or misuse of goods, or of reasonable wear and tear.

Loss of Data

Even the most reputable and reliable components will occasionally fail early in their expected lifespan. The customer is responsible for ensuring that their data, especially any of importance and/or value, is safely backed up in case of hardware failure. We accept no responsibility whatsoever for any loss of data from our customers' systems.

Refunds

In the first instance, and if possible, all refunds will be made to the original payment method unless otherwise agreed with the customer. If this is not possible, we will contact you to arrange an alternative refund method. We will be under no obligation to provide a refund in the unlikely event that, despite our best and repeated efforts, you fail to provide us with a valid method for the transfer of funds.

"No Junk" Guarantee

Our "no junk" guarantee refers to our promise not to use "generic" components, or components from manufacturers we do not deem to be "established" brands, in the main components of the PCs we sell. It also refers to our promise not to use out-of-date components.

"Main components" in this case refers to: motherboards, CPUs, CPU coolers, RAM, GPUs, PSUs, drives, and computer cases.

"Out-of-date components" in this case refers to CPUs and GPUs (which have a relatively short generational lifespan) that are more than two generations older than the current generation. Exceptions to this are if instructed by the customer to do so, or if we believe there to be a good technical reason for doing so.

We will endeavour to ensure that all other components are of sufficient quality for any goods that have been ordered.

Pricing, Errors and Component Availability

Our current standard rate for repairs, upgrades and/or other technical services is available on request.

If an incorrect price is displayed on this website or otherwise communicated to you due to typographical error, misreading, or error in pricing of our suppliers, we reserve the right to cancel or refuse any orders to which that price pertains, even if confirmation of the order has been issued.

As a small business we are highly vulnerable to any change in price or availability of the components we sell. This can cause us problems in the event of component unavailability or significant price rises. All prices communicated, through this website or otherwise, are therefore conditional on the relevant components being available, and that they have not risen in price by a significant amount compared to the value used to calculate the sale price of any of our goods or services.

We are under no obligation to you to fulfill any orders at the communicated price should these conditions not be fulfilled. Any price should only be considered final once any products are assembled or otherwise in our possession.

In the event that these conditions are not fulfilled, all reasonable attempts will be made to contact the buyer of the relevant goods and/or services to approve an appropriate substitution, cancellation of the order, or change in price. If such contact is not possible, we reserve the right, if we feel it is possible and appropriate, to substitute any component for one of similar quality and specifications.

If such a substitution is not possible, or if agreement on such a substitution or price change is not reached, we reserve the right to cancel that order and refund any relevant payment made to us. We accept no liability in the event that any of the above rights are exercised.

Force Majeure

We will be under no liability whatsoever in the event that we are prevented from fulfilling any agreement relating to the sale and provision of goods and/or services by any reason or cause beyond our reasonable control.

Jurisdiction

These terms and conditions, and all agreements relating to the sales of goods and services by Indigo PC, will be subject to English law. All parties hereto submit to the exclusive jurisdiction of the English courts.
